Trademark registration for a Label, Logo, Slogan, Punchline, or Tagline is filed before the Registrar of Trademarks under the proper territorial jurisdiction with the required documents. After a formality check, the application proceeds to examination and hearing. On approval, it is accepted, advertised, and eventually registered for 10 years.
The application is filed in FORM TM-A under Section 18(1) with the label/logo, authority letter, user affidavit, and other required documents along with the Govt. fee.
Can be used immediately upon filing the application to indicate intent.
Exclusive right. Used strictly only after the registration certificate is issued.
Normally, objections are raised by the Examiner for violation of legal provisions or similarity with earlier marks on record. After filing replies, the Examiner decides whether the mark will be granted or fixed for hearing.
If replies to the initial examiner objections are not found completely satisfactory, the matter is scheduled for a formal hearing.
If, at the hearing, the arguments presented are not found satisfactory, the mark is officially refused by the Registrar.
Once a mark is refused, a Review Application under Section 127(c) read with Rules 115 and 119 can be filed within 1 month against the Registrar’s decision. The review application must include the grounds of review, statement of case, required documents, and Govt. fee. After filing, the Ld. Registrar fixes a hearing date and passes the order accordingly.
Our team assists with trademark search, filing, objections, hearings, renewals, assignments, and complex trademark protection matters across India.
